developing news -- investigators are at the scene of a homicide in san jose. you. you may have to pay more at many east bay stores tomorrow and you may not know it until you check out. and we're live in washington watching last-minute negotiations for the fiscal cliff -- at noon.

it appears that an agreement to prevent this new year's tax hike is within sight but is not done. >> a little more than an hour ago, the president said he's optimistic that the u.s. economy will not go over the fiscal cliff. that's one of the top stories this noontime. good afternoon. i'm david stevenson. we begin with developing news at this hour. san jose police are investigating the city's 46th homicide of the year.

it happened at an apartment complex on lewis road off monterey highway and janine de la vega joins us from the scene. janine, we understand police may no who may be responsible -- may know who may be responsible. >> reporter: that's right. they have two adult males detained and they are questioning them and treating them as persons of interests. homicide detectives are here at the sulker breeze apartments. all of the activities seem to be centered around a parking garage. just before 9:30 this morning, they received a 911 call that a man with a gun was at the -- on the grounds. when police arrived, they found a manner in a car shot. paramedics tried to revive him. but he died on the scene. after talking to a couple of witnesses they've determined some sort of confrontation occurred with the victim and two other men. >> what happened exactly, we don't know. we're in the very early stages

of the investigation. we do have a couple of people detained and we have the weapon involved in custody. >> reporter: there were surveillance cameras inside the garage. police are working to look at that video. officers say not too many people heard the gunshots so they are looking for additional witnesses. at this point, police say there are no outstanding suspects because they believe they have who is responsible detained. detectives plan to be out here processing the scone for the next couple of hours. janine de la vega, ktvu channel 2 news. >> thank you, janine. there are new developments today in efforts to keep the country from going over the fiscal cliff at midnight. president obama addressed the nation and said a resolution is within sight. kyla campbell joins us from washington with the issues that still remain unresolved good afternoon, kyla. >> reporter: david, i just got off the phone with senate officials and they say there's no word yet on a possible vote today. with the hours ticking away,

president obama came out to say a deal is in sight but it's not yet complete. vice president joe biden took over negotiations with mitch mcconnell yesterday after talks stalled between senate leaders. now, mcconnell said just minutes ago he wants to move forward on the tax offer and the latest democratic offer is to raise taxes on households making more than $450,000 a year. but there's still disagreements about spending cuts. >> that has been a good faith negotiation. we all want to protect tax payers. and can get it done now. >> we have to do this in a balanced and responsible way and if we're gonna be serious about deficit and debt reduction, there will have to have be some sacrifices. >> reporter: -- there have have to be some sacrifices. >> reporter: again, no votes have been scheduled at this

point. kyla campbell, ktvu channel 2 news. >> thank you. with all of the focus on the fiscal cliff, a new bill to prevent the so-called dairy cliff is also in play today. the house is expected to vote on a one-year extension of the expiring u.s. farm bill. leaders from the house and senate agricultural committees have already agreed to the bill. if it's not passed, milk prices could double up to $8 a gallon. a number of new laws are ahead for the new year, including one in alameda county that claims to keep plastic bags out of the hands of shoppers. new at noon, brian flores is live with a new bag ban and reaction from residents and a store manager. >> reporter: hi, david. plastic bags could be a thing of the past. starting tomorrow, shoppers are urged to bring in their own reusable bags or will be charged for each paper bag they use. >> happy new year. >> reporter: with the new year comes new laws for shoppers in

alameda county. starting tomorrow, customers will need to bring in their own reusable bag. or if they forget, they will need to shell out 10 cents per bag. >> i don't think it will hurt my pocketbook. hopefully it will remind me to bring my own bags. today i forgot. i think if i have to pay 10 cents for every bag i use, it will start to stick in my head. >> reporter: the ordinance goes into effect tomorrow that will eliminate plastic bags for supermarkets, liquor stores, pharmacies. >> it will be an inconvenience but it's a reasonable inconvenience. >> i don't think that very many people are going to really feel a huge pinch because of a 10- cent charge. >> reporter: the premise of the according, according to the alameda waste county authority is to reduce the amounts of bags in rivers, creeks and

waterways. they will begin to increase the ordinance tomorrow to those businesses who don't -- don't apply. many grocery stores are looking at a push of reselling reusable bags already. >> we'll find out. it's new year's eve. we'll know better in the weeks to come. i think overall, people have been using reusable bags for long enough and it's not too mu. it takes a while to break those habits. >> reporter: in talking with alameda county officials they tell us stores who don't comply could be charged up to little $500. brian flores, ktvu channel 2 news. >> thank you, brian. the cold freezing weather early this morning caused icy conditions and accidents on bay area roads. the highway patrol says black ice caused a car to roll over on to an embankment off san

pablo road near orinda. the chp says a short time later, there was another accident in the same area. no one was seriously injured in either incident. inspiration point was closed for about an hour and a half. icy conditions are plameed for accident in petaluma this morning. the driver of a pickup truck hit black ice and caused the vehicle to flip on its side on petaluma south. there are no reports of injuries. steve paulson joins us in ten minutes to tell us how long this chilly weather will remain in the area. oakland police are checked to release the name in the shooting death of a 15-year-old gill. the teen was running with friends yesterday afternoon when a gunman opened fire on the group. a 14-year-old boy was also shot. he ran a full city block and hid until police arrived. police have been reviewing surveillance video and

interviewing witnesses in hopes of identifiy the suspect. san jose fire investigators continue to look for a cause in a fatal fire that claimed the lives of a young girl and her grandparents everyone the fire broke out late knight in a second floor apartment on bridgeport court in west san jose. the 5-year-old man, his wife -- the 56-year-old man, his wife and daughter died in the fire. the fire damaged several other units. the fire displaced dozens of residents who are now receiving assistance from the red cross. a natural gas line burst outside a home thats with on fire. the gas leak sent flames shooting into the air on athens street around 1:00 this morning. ktvu's alex savidge reports on why this was such a difficult fire to knock down. >> reporter: a dangerous situation for san francisco firefighters trying to control an early-morning house fire in

the excelsior district. flames began shooting from a natural gas line in front of the place. a deputy chief told me the fire was essentially gas-fed at one point and crews couldn't reach the shutoff valve because it was engulled in flames. >> they had to have that free burning for a long time until pg&e could put a hole in the street and shut it off from there. we couldn't get to the shutoff area because the fire was come coming up from the sidewalk there. >> reporter: it took more than five hours for the pg&e to dig up the road. moon time, firefighters let the gas burn itself off. crews say that was the safest approach. the four people inside the burning home, all managed to escape. three were transported to the hospital with minor injuries. an aggressive attack by firefighters helped keep the flames from spreading. the man who lives next door told me he's glad a neighbor woke him up to warn him about the foyer. >> luckily, the neighbors right here came knocking really hard to get us up because, you know,

i was caught in a fire before and i almost didn't make it because of the smoke. so i'm very grateful. >> reporter: crews say the fire began in the garage area and then spread to the gas meter and quickly grew inside. a pg&e representative told me this morning the fire was not related to a faulty line. according to the deputy chief there's nothing at this point to suggest the fire is suspicious. still an arson investigator was called in. this hem has been red tagged after this morning's fire. there was so much damage inside, the building inspector determined the place is not structurally sound. in san francisco, alex savidge, ktvu channel 2 news. hundreds are gathered in upstate new york to build their final farewells to a fallen firefighter. mourners packed the church for the funeral of the 19-year-old. he was one of two first responders who was shot and killed in an ambush on christmas eve. >> the gunman lured the first

works for san francisco. allie rasmus joins us with the party plans that include a lot of fireworks and safety measures being put in place right now. >> reporter: the crowd control barricades are right in front of us, stacked up and ready to go at the embarcadero ahead of the big fireworks display in san francisco. pyrotechnics stuffed packets of gun powder into these plastic shelves. the preparations here were spread out across two barges docked at pier 250. >> there's hundreds of shells. >> reporter: 12 hours from now, they will unleash a shell of colors for the new year's eve fireworks celebration. >> the 15-minute show is carefully planned and electronically timed. >> the shells are timed every time they are supposed to go off. >> reporter: this is video from last year. this year is expected to be just as big with more than 4500 different shots of dazzling lights in effect.

250,000 people came to the embarcadero to watch the fireworks last year but with clear skies and dry weather expected tonight, the crowd could be even bigger. new year's eve partiers say there's only one way to get to the city tonight. >> public transit in general is a great idea. park something a nightmare -- park something a nightmare. >> i would -- parking is a nightmare. >> i would say b.a.r.t. >> reporter: caltrain and sam transwill have free rides after 11:00 tonight and the last caltrain line will heave san francisco at 2:15. in san jose, vta is also free after 7. on party you will have to pay for your ticket. the trains will run until 3:00 a.m. partygoers say the free rides and extended hours are a much appreciated public service. >> it keeps drunk drivers off the roads. people safe. >> reporter: now, not all of the b.a.r.t. trains will be stopping at all of the san francisco stations. the pittsburg bay point train
